What is the Visa Diversity Lottery?
The visa lottery is a diversity visa program administered by the State Department as an approach to broaden the diversity of foreigners coming to live in the United States.
Each year, approximately 50,000 randomly selected foreigners from countries that do not send enough immigrants to the United States obtain permanent residency (usually called a “green card”) in the United States through the Diversity Visa Program. This is a pathway for individuals and families who would otherwise have no legal means of traveling to the United States to obtain a green card.
Entering the Diversity Visa Lottery (also known as the Green Card Lottery) is free, as it involves filling out a simple online form. Applicants can participate in the drawing from early October to early November. Winners are selected randomly by a computer, and they and their immediate family members receive Green Cards.
History of the diversity visa
As a means of increasing diversity among immigrants to the United States, the Diversity Visa was created by the Immigration Act of 1990. There are many countries from which the immigrant group to the United States comes; in order to increase diversity, the DV lottery was created to allow small countries to send as many immigrants as possible to the United States.
The Diversity Visa program is primarily the responsibility of the U.S. Department of State. The State Department administers the lottery and selects the winners. It is estimated that 95% of DV lottery winners receive their green cards through the State Department because they are residents outside the United States when they are announced as winners.
The fact that the diversity visa currently exists does not mean it is not subject to change. Several past and present immigration reform bills in Congress would eliminate the program entirely; however, none of these proposals have been passed yet.
Who is eligible for the diversity visa?
To be eligible for the Diversity Visa, you must be a citizen of a country that has sent fewer than 50,000 immigrants to the United States in the past five years. There is some annual variation in eligible countries; however, countries like Canada, China, India, Mexico, and the United Kingdom are never on the list of eligible countries because they send a large number of immigrants to the United States each year.
If this country does not qualify, there are two other ways to qualify for the diversity visa:
If your spouse/partner is a citizen of an eligible country, you can apply with your spouse/partner by selecting your spouse’s/partner’s country on your application.
In the event that neither of your parents was a legal resident of your country of birth, you can choose between the country of birth of your father or your mother.
Education
Having at least a high school diploma is a mandatory requirement when applying for the DV lottery, or a minimum of two years of relatable work experience in the past 5 years in an occupation that requires a minimum of 2 years of training, as specified by the U.S. Department of Labor.
